On May 2, 2016, the Federal Aviation Administration announced that it was seeking comments on three alternative criteria for the eligibility of rail access projects for PFC funding. Historically, the FAA has allowed PFCs to fund these types of ground access projects only to the extent they were for the “exclusive use” of airport patrons. Under the proposed alternatives, airport sponsors would be able to demonstrate a portion of such of a project’s cost that should be eligible for PFC funding, even if that portion is not for the exclusive use of airport patrons. Comments on the FAA’s proposal must be received by June 2, 2016.
